Terms of Service

1. Acceptance of Terms
By accessing or using Socialyte ("the App"), operated by Socialyte Labs Inc. ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Age Requirements and Verification
Minimum age: You must be at least 13 years old to create an account. This is required by the Children's Online Privacy Protection Act (COPPA).
Minor protections: Users between 13 and 17 years old have accounts automatically set to private. This restriction cannot be changed until the user turns 18.
Age misrepresentation: By providing your birth date, you certify that the information is accurate. Providing false age information is a material breach of these Terms and may result in immediate account termination. You acknowledge that misrepresentation voids these Terms, we are not responsible for consequences arising from age falsification, and you assume all liability for violations of age restrictions.
3. Account Responsibility
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.
4. Privacy and Data Protection
Our Privacy Policy is incorporated into these Terms by reference. Users under 18 receive enhanced privacy protections, including mandatory private accounts and restricted data sharing.
5. Content and Conduct
You are responsible for all content you post. You agree not to post content that:
- Violates any laws or regulations
- Is harmful, threatening, abusive, or harassing
- Infringes on intellectual property rights
- Contains false or misleading information
- Is sexually explicit or inappropriate for minors
- Promotes illegal activities or violence
6. Intellectual Property
The Socialyte app, including its design, features, and branding, is owned by Socialyte Labs Inc. and protected by copyright, trademark, and other intellectual property laws. You retain ownership of content you create but grant us a license to use, display, and distribute your content on the platform as needed to operate the service.
7. Copyright and User Content
You are solely responsible for ensuring content you upload does not infringe third-party intellectual property rights. By uploading content, you represent that you own all rights or have obtained necessary permissions.
Socialyte is a platform provider and is not responsible for monitoring or verifying the legality of all user-generated content. If you believe content infringes your copyright, submit a DMCA notice as described in our DMCA policy.
8. User Indemnification
You agree to indemnify and hold harmless Socialyte Labs Inc., its officers, directors, employees, and agents from claims arising from your use of the service, violation of these Terms, violation of third-party rights, or content you post.
9. Changes to Terms
We may modify these Terms at any time. We will notify users of material changes through the app or by email. Continued use after changes constitutes acceptance of the new Terms.
10. Payments, Tips, and Creator Plans
Tips and Creator Plan subscriptions are processed by Stripe. By sending a tip or subscribing, you authorize Stripe to charge your payment method. Platform and processing fees are disclosed before you confirm. Creator payouts are issued through Stripe Connect subject to identity verification and applicable tax rules.
11. Referral Program
Referral rewards require verified referrals (watch-time thresholds defined in-app). Rewards are non-transferable, may be revoked for fraud or abuse, and are subject to change. Referral links must not be used for spam or misleading promotion.
12. Automated Systems and Moderation
We may use automated systems to categorize content, improve recommendations, and enforce community guidelines. Automated decisions may be reviewed by humans where required by law.
13. Termination
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or pose a risk to other users or the platform. You may delete your account at any time through the App.
14. Disclaimer of Warranties
The App is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service.
15. Limitation of Liability
To the maximum extent permitted by law, Socialyte Labs Inc. shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the App.
